Northamptonshire man spared jail after sexual activity with underage girl

Mark Davies, of Tennyson Road, Daventry, will however have to sign the sex offender register indefinitely and carry out a three year community order, a three year supervision order, and he will have to attend a sex offender rehabilitation program.

The 21-year-old had already pleaded guilty to sexual activity with a child last year.

During the sentencing hearing at Northampton Crown Court yesterday, Mr Thomas said Davies gave an admission to police during his first interview in June last year.

Defending for him Laban Leake said Davies told officers he wanted to “do the right thing and tell the truth” while he was sat in the police car following his arrest.

Mr Leake pointed to a psychological assessment carried out on Davies while he awaited sentence, which found the 21-year-old had “autism,” “limited maturity” and “limited intellect”.

Judge Adrienne Lucking QC said this played a large part in her decision not to send him straight to jail.

She said: “Normally someone in your position would go immediately to prison, however there are some very, very exceptional circumstances where you would not.

“Having read the full psychologists’ report I am satisfied it should not result in you losing your liberty.”
