Northampton businessman successfully appealed 20 tickets in 18 months

A BUSINESSMAN who says he has successfully appealed against 20 parking tickets issued to him in the same street in just 18 months has won the backing of his MP.
Chris Kellett who runs D&S Autos on the Mounts Business Centre in William Street, Northampton has said the number of tickets being handed to him and other business owners on the estate is seriously damaging trade in the area.
He said: “The issue we’ve got is this an industrial estate, but the traffic wardens are treating it like it’s a residential area.
“I’ve appealed against about 20 tickets now and we’ve won them all.
“But the real problem is the impact it’s having on business. I’ve had customers pull up at the garage who have been warned they’re going to get tickets if they stay. It’s all totally wrong.
“And it’s wasting taxpayer’s money giving me all these tickets when they know I’m going to appeal against them and win.”
Mr Kellett has won appeals against tickets issued in William Street because yellow lines on the road are not properly painted and there are no signs warning drivers about parking restrictions.
After writing to Northamptonshire County Council a number of times to raise concerns about the issue, the Conservative MP for Northampton South, Brian Binley, visited William Street yesterday to see the problem for himself.
He said: “There are clearly no problems with parking on this street.
“And the county council has been told time and time again that the road markings and the signs are wrong, so I’m going to get in touch with them and try to put a stop to this situation.
“It seems to me that the businesses in Wellington Street are being unfairly harassed and the authorities need to realise they’re actually paid by people who run businesses like the ones here.
“They should be doing all they can to help them.”
A spokesman for the authority admitted there were problems with parking signs in William Street, but insisted the problem was being looked at.
She said: “We are aware that there is an issue with signs being defaced on this road and this is causing confusion.
“We are looking into this issue and in the meantime, an appeals process is in place for anyone who is unhappy about receiving a ticket.”

Thursday, February 16, 2012 at 11:56 AMThe law is too complicated as far as signs go - too many loopholes for those that want to play games with the rules. Paint double yellow lines, if you park on them you get a ticket.

Wednesday, February 15, 2012 at 04:37 PMA large number of the parking regulations in the County are non enforcable because the Trafic Regulation Orders they refer to do either not exist or are outdated. Others are invalid because the signage is inadequate to describe the meaning. For example a sign saying "Permit Parking Only" is invalid as it needs to tell you what permit is needed and what the hours of operation are. In my area (Billing Road) NCC replaced the old signs with new signs at a cost of £27,000 which now refer to a Traffic Regulation Order that they have not yet submitted! At the same time they are going out to consultation to change the scheme! What happens if the consultation leads to changes outside of their planned, but not yet submitted new TRO? We will recycle the signs they say. So why didn't they recycle the last lot? NCC use their parking powers as a cash revenue power, at a time when they are cutting funding for PCSO's they are increasing the number of Traffic Enforcement Officers on the street. This whole fiasco is a mess of their own making and yet still they punish drivers in the hope that no one will fight back. Fight every ticket!
