Euro court makes mockery of justice
IT is 12 months since top British Judge Lord Hoffman warned that the European Human Rights laws were getting out of control and warned David Cameron the Court was desperately in need of a huge reform.
Human rights have become he believes, like health and safety, a byword for foolish decisions by courts and administrators.
And just when you think the reputations of the European Conventions of Human Rights can’t sink any lower, along comes the case of Abdullah Munawar, a 23-year-old Bangladeshi.
He came to Britain to study accountancy.
His visa was supposedly strictly limited. But thanks to the European Convention for Human Rights, there is now, it turns out, no such thing as a limited student visa. And he’s been granted permission to remain here.
Why? Because he plays cricket on Sundays and he is entitled to stay in the UK under Article 8 of the ECHR which protects his right to a “private life”.
Another case that makes a mockery of British Justice is that of Rupert Massey, jailed for six years for sexual abusing three schoolboys. He claimed the four years it took to bring him to court had left him “stressed” and infringed his right to a fair trial.
He was awarded nearly £6,000 . . . the same compensation given to one of his victims. The European court has a backlog of more than 150,000 cases.
Come on David Cameron get a grip and stand up for British interests or have the guts to pull out of the EU.
I’d love to wipe that grin off Daniel Chrapkowski’s face. He was one of a gang of three thugs who attacked an innocent man in the street and put him in hospital for a month.
In the court he told the judge he was very sorry for his actions.
Their victim Joseph O’Reilly, 24, was repeatedly punched and kicked in the face and stomach before the gang ran off. He spent 40 hours undergoing X-rays and scans.
He suffered a badly fractured jaw and a bleed on the brain and was forced to have a metal plate fitted into his face.
Tattooed, jobless Chrapkowski, 24, from Stockport, was given a 12-month suspended prison term, tagged for two months and ordered to do 160 hours’ unpaid work after admitting causing Joseph O’Reilly grievous bodily harm.
Outside the court Chrapkowski punched his fist in the air delighted he had conned the judge into believing he really was sorry.
Once again one of our judges showed complete lack of judgement to be taken in by this moron.
All we can hope is that the police can see what a con man Chrapkowski is and they bide their time and get him next time he steps out of line.
Are people in the UK becoming more dishonest? According to a survey carried out by the University of Essex, people are becoming more dishonest and are also more tolerant of bad behaviour such as condoning having an affair.
Most of us like to think we would do the right thing, such as handing in money found in the street or leaving a note when accidentally bumping a car.
The sad truth, according to Professor Paul Whiteley, is that if people can get away with it they probably will.
Why so bad in 2012? I believe because of the number of divorces, children do not grow up being influenced by both parents and, of course, grandparents who would re-enforce what is right and wrong.
